Article 3 – Scope of these terms

  1. These terms apply to offers made by Silly Shepherds and consumer purchases for which Silly Shepherds is the seller.

  2. They cover physical products, digital products, and personalized products where offered.

  3. If you purchase from another seller through Amazon or another platform, your purchase is governed by the applicable seller’s terms, the platform’s relevant procedures, and applicable law. Article 15 explains this distinction.

  4. The availability of an English-language website does not mean that we offer direct delivery to every country. Available destinations and purchase options are shown during checkout or confirmed before we accept your order.

  5. Nothing in these terms excludes or limits consumer rights that cannot lawfully be excluded or limited.

Article 4 – Product information

  1. We aim to describe our products accurately and clearly.

  2. Product images are intended to represent the product as closely as possible. Minor differences in screen colors, printing, or appearance may occur. This does not excuse material differences from the product description.

  3. Book specifications may vary by edition, language, or sales channel. Please check the description of the particular edition you are purchasing.

  4. Digital products are identified as digital downloads rather than physical items.

  5. If an obvious error appears in a description or price, we may correct it as permitted by law. If it affects an order you have placed, we will contact you. We will not substitute a higher price without your agreement.

Article 5 – Placing and accepting an order

  1. A contract is formed when you place an order and we accept it.

  2. We provide electronic confirmation of your order. An automated acknowledgment of receipt does not, by itself, constitute acceptance unless it expressly states that your order has been accepted.

  3. Please check your name, delivery address, email address, and other order details before submitting your order.

  4. We may request additional information or decline an order on reasonable grounds, such as suspected fraud, misuse, unavailable delivery arrangements, or materially incorrect information.

  5. If we decline an order after receiving payment, we will refund that payment.

Article 6 – Prices, currencies, and taxes

  1. The currency applicable to a direct purchase is shown with the price or during checkout. Prices in different currencies are not necessarily equivalent.

  2. Applicable taxes are included or separately identified as required by law. Shipping charges and the total amount payable to us are shown before you submit your order.

  3. Prices displayed by Amazon or another seller may differ from our direct prices and may vary by marketplace, currency, format, and tax treatment.

  4. International shipments may be subject to import duties, local taxes, customs clearance charges, or carrier handling fees that are not collected at checkout.

  5. Unless we expressly state that these charges are included or that we will pay them, you are responsible for applicable import charges, to the extent permitted by law.

  6. Later price changes do not affect orders we have already accepted.

Article 7 – Payment

  1. Available payment methods and payment arrangements are shown during checkout.

  2. Payment must be made according to the agreed arrangements. Any advance-payment requirements remain subject to applicable consumer law.

  3. Please inform us promptly if you notice an error in your payment or order details.

  4. Currency conversion charges or fees imposed by your bank or payment provider are governed by your agreement with that provider.

Article 8 – Delivery of physical products

  1. We deliver to the address provided with your order, provided delivery to that destination has been accepted.

  2. Estimated processing and delivery times are shown on the website, during checkout, or in our order confirmation.

  3. An estimated delivery date is not a guaranteed date. However, estimates do not override an agreed delivery deadline or your statutory rights.

  4. We will deliver within the agreed timeframe and comply with any applicable statutory delivery requirements.

  5. If we cannot fulfill your order or expect a significant delay, we will inform you promptly. Where required by law, we will seek your agreement to a revised timeframe or allow cancellation and a refund.

  6. Risk of loss or damage remains with us until you, or someone you designate other than the carrier, takes physical possession of the product. Any exception where you independently appoint a carrier applies only to the extent permitted by law.

  7. Carrier or customs delays do not remove our responsibilities to you under applicable consumer law.

Article 9 – Cancellation of standard physical products

  1. For standard physical products purchased directly from us, we provide a 14-day cooling-off period, subject to the exceptions in these terms. Where the law requires this period, it is a statutory right. Elsewhere, we offer it as our contractual cancellation policy.

  2. The period begins on the day after you, or someone you designate other than the carrier, receives the product. For split deliveries, any applicable statutory rules determine when the period begins.

  3. You may cancel without giving a reason by sending us a clear statement of your decision within the cooling-off period.

  4. You can notify us by emailing info@sillyshepherds.com, using a cancellation form, or using the online withdrawal function where available or required. You do not have to use a particular form.

  5. You may inspect the product as you would in a store. If you handle it beyond what is necessary to establish its nature, characteristics, and functioning, we may deduct a resulting reduction in value only where legally permitted.

  6. Original packaging is helpful but is not a mandatory condition for exercising a statutory cancellation right.

  7. Any longer cancellation period or additional protection required by applicable law takes precedence.

Article 10 – Returns and refunds following cancellation

  1. After notifying us of cancellation, send the product back within 14 days, unless applicable law provides a different period.

  2. Please return it to the address in Article 2 and package it carefully. Keep proof of shipment.

  3. You pay the direct return shipping costs if we disclosed this before purchase, unless we agree otherwise or the law requires us to pay them.

  4. For cancellation of the entire order, we refund the purchase price and the cost of our least expensive standard delivery option.

  5. Additional charges for a more expensive delivery option you selected are not refunded unless required by law.

  6. We will issue the refund within 14 days after receiving your cancellation notice. Where permitted by law, we may withhold it until we receive the returned goods or evidence that you have sent them back, whichever occurs first.

  7. Refunds are made using the original payment method unless you expressly agree otherwise. We do not charge a refund processing fee.

  8. These change-of-mind return arrangements do not limit your rights concerning faulty, damaged, incorrect, or misdescribed products.

Article 11 – Personalized and custom-made products

  1. The change-of-mind cancellation policy does not cover products made to your specifications or clearly personalized for you, except where applicable law requires otherwise.

  2. Examples include products featuring a name, photograph, text, or original design supplied by you.

  3. A standard product is not automatically excluded merely because it is produced after you order it.

  4. This exception does not remove your rights if the product is faulty, damaged, incorrectly supplied, or does not match the agreed specifications.

  5. Any applicable statutory remedies remain available.

Article 12 – Digital products and EPUB files

  1. Digital products are delivered after payment according to the arrangements shown during checkout, for example through a download link.

  2. Where applicable law provides a cooling-off period for digital content, that period and its conditions apply.

  3. Where legally permitted, your statutory cancellation right may end when supply begins if:

    • You have expressly consented in advance to immediate supply.

    • You have expressly acknowledged that you will lose that cancellation right when supply begins.

    • We have provided the legally required confirmation of your consent and acknowledgment.

  4. Consent must be actively given. Accepting these general terms alone is not sufficient.

  5. Where no statutory cooling-off right applies, immediately supplied digital downloads are not covered by a change-of-mind return policy unless we expressly offer one.

  6. These provisions do not remove your rights if a file is incorrect, defective, not supplied, or does not meet the agreed description.

  7. An EPUB is licensed for your personal use unless we agree otherwise.

  8. Except with permission or as permitted by law, you may not redistribute, resell, share with others, upload to sharing platforms, or commercially exploit the file.

  9. Personal backup copies are permitted to the extent allowed by law.

  10. Please check the stated format, functionality, and compatibility requirements before purchase. We provide relevant compatibility information where required. Your responsibility to use suitable equipment does not excuse incorrect or misleading compatibility information from us.

  11. Kindle editions purchased through Amazon are supplied under the applicable Amazon arrangements. They are separate from EPUB downloads purchased directly from us.

Article 13 – Product quality and statutory consumer rights

  1. Products must match their description and meet the quality, fitness, durability, and other standards required by applicable law.

  2. Your statutory rights are separate from any additional commercial warranty. These terms do not impose a universal warranty expiry date.

  3. Depending on applicable law and the circumstances, remedies may include repair, replacement, a price reduction, cancellation, a refund, or compensation.

  4. We are not responsible for a problem to the extent that it was caused by misuse, accidental damage you caused, or failure to follow appropriate instructions, as permitted by law.

  5. Normal wear does not itself establish a defect. However, premature deterioration may breach applicable durability or quality requirements.

  6. Digital products are also subject to applicable rules governing digital content, including any mandatory obligations concerning conformity or updates.

  7. Where Australian Consumer Law applies, our products come with consumer guarantees that cannot be excluded. For a major failure involving goods, you are entitled to choose a replacement or refund and may be entitled to compensation for other reasonably foreseeable loss or damage. For other failures, you are entitled to the remedies required by that law.

  8. Mandatory protections under applicable UK, US, Canadian, New Zealand, or other consumer laws remain unaffected.

Article 14 – Damaged, defective, or incorrect products

  1. If a product arrives damaged, is incorrect, or appears defective, please contact info@sillyshepherds.com promptly.

  2. Please provide your order number, a description of the problem, and photographs if available and helpful.

  3. Photographs help us investigate but are not an absolute condition for exercising statutory rights.

  4. We will provide an appropriate remedy in accordance with applicable law.

  5. Where we are legally responsible for the problem, we will bear any necessary return, repair, or replacement costs as required by law.

  6. A request to contact us promptly does not shorten any statutory claim period.

Article 15 – Purchases through Amazon or other sellers

  1. Our website may link to Amazon or other external sellers and platforms.

  2. Check the product listing and order confirmation to identify the seller of your purchase. A platform providing payment or fulfillment services is not necessarily the seller.

  3. If another business is the seller, your purchase contract is with that business. Its terms and the platform’s applicable procedures govern order handling, subject to applicable law.

  4. For payment, delivery, returns, refunds, or order complaints, contact the seller or platform where you placed the order.

  5. We do not have access to another seller’s order or payment records and cannot process its returns or refunds. Do not send those returns to us.

  6. If Silly Shepherds is identified as the seller, using an external platform does not remove our legal responsibilities as the seller.

  7. We do not control independent sellers’ prices, stock availability, delivery estimates, or service policies.

  8. Questions about the content of our books are always welcome, wherever you purchased your copy.

Article 16 – Intellectual property

  1. Copyright and other intellectual property rights in our books, EPUB files, text, photographs, videos, designs, illustrations, logos, and other content remain with their respective rights holders.

  2. Purchasing a product does not transfer ownership of those intellectual property rights.

  3. You may not reproduce, publish, distribute, or commercially use protected content without permission, except where applicable law permits it.

  4. These terms do not restrict lawful quotation, fair use, fair dealing, or other applicable statutory exceptions.

Article 17 – Materials supplied for personalized products

  1. If you supply text, photographs, images, or other materials, you confirm that you have the rights or permissions needed for us to use them to fulfill your order.

  2. You must not supply unlawful material or material that infringes another person’s rights.

  3. You give us permission to use the supplied materials for producing and fulfilling your order. This does not give us permission to use them for unrelated advertising.

  4. We may decline an order if we reasonably believe the supplied materials cannot lawfully be used.

  5. Any responsibility for third-party claims arising from materials you supply will be determined under applicable law.

Article 18 – Liability and informational content

  1. We remain responsible for losses and damage to the extent required by applicable law.

  2. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including applicable liability for fraud, negligence causing death or personal injury, defective products, or breaches of mandatory consumer rights.

  3. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable consequences of a breach.

  4. Incorrect information you provide may affect our ability to fulfill your order. Responsibility for resulting losses will depend on the circumstances and applicable law.

  5. Content about dogs, training, behavior, care, and health is provided for general information. Individual dogs and circumstances differ, and no particular training result is guaranteed.

  6. Where appropriate, seek individual advice from a veterinarian or suitably qualified behavior or training professional, especially for medical concerns, serious aggression, or safety issues.

  7. This informational statement does not remove any responsibility that cannot lawfully be excluded.

Article 19 – Events beyond our reasonable control

  1. Events beyond our reasonable control may affect fulfillment. These may include severe weather, natural disasters, government restrictions, strikes, armed conflict, or major disruptions affecting essential suppliers.

  2. If such an event affects your order, we will inform you and take reasonable steps to reduce its impact.

  3. These circumstances do not automatically remove our responsibilities as the seller.

  4. Your applicable rights concerning delivery, cancellation, refunds, and other remedies remain in place.

Article 20 – Complaints

  1. For purchases directly from us, email complaints to info@sillyshepherds.com.

  2. Please include your name, order number if applicable, and a clear description of the problem.

  3. We will acknowledge your complaint and aim to provide a substantive response within 14 days.

  4. If we need more time to investigate, we will let you know.

  5. If we cannot resolve the complaint together, you may use any applicable court procedures or eligible alternative dispute resolution process.

  6. For purchases from another seller, follow the complaint procedure of that seller or platform, as explained in Article 15.

Article 21 – Governing law and international consumers

  1. Contracts for which Silly Shepherds is the seller are governed by Dutch law.

  2. This choice of law does not deprive you of mandatory consumer protections that apply under the relevant conflict-of-law rules.

  3. Depending on your residence, how the sale was offered, and applicable law, additional national, state, provincial, or territorial protections may apply.

  4. Nothing in these terms requires you to give up a mandatory right to bring proceedings in a court available to you under applicable law.

  5. These terms do not impose mandatory arbitration or a waiver of statutory rights to participate in collective proceedings.

  6. An English-language version of the website does not, by itself, establish that every product can be ordered or delivered in every English-speaking country.

Article 22 – Changes to these terms

  1. We may update these terms for future purchases.

  2. The terms in effect when your contract is formed apply to that purchase.

  3. Later changes do not apply retroactively unless required by law.

  4. Any mandatory consumer protections remain unaffected.

Article 23 – Invalid or unenforceable provisions

If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Any invalid provision will be dealt with under applicable law. It will not be replaced or interpreted in a way that reduces mandatory consumer protections.

Article 24 – Final provision

These terms govern purchases for which Silly Shepherds is the seller, including physical products, digital content, and personalized products where offered.

For purchases from Amazon or another independent seller, please refer to Article 15.
